1. Introduction
The Wardrakes' Inc. ("Wardrakes," "we," "us," or "our") respects your privacy. This Privacy Policy explains how we collect, use, store, share, and protect personal information when you use websites, mobile applications, and services we operate (collectively, the "Services").
By using the Services, you agree to the collection and use of information in accordance with this Policy. If you disagree, please do not use the Services.
2. Information We Collect
Information you provide
- Account information: email address, password (hashed), display name, optional profile details such as date of birth or pronouns.
- Payment information: processed by our third-party payment processors (PayPal, Google Play, Apple App Store, and others). We do not store full payment card numbers on our systems; we receive only transaction identifiers, billing status, and the last four digits where applicable.
- User content: messages, prompts, uploaded images, and other content you submit while using the Services.
- Communications: any information you send to us via email or support channels.
Information collected automatically
- Usage data: features accessed, AI Credits consumption, session timing, error reports.
- Device information: IP address, browser or app version, operating system, device identifiers, and approximate location derived from IP address.
- Cookies and similar technologies: small data files stored on your device for authentication, preferences, and analytics. You can manage cookies through your browser settings; some features may not work if cookies are disabled.
3. How We Use Information
We use the information we collect to:
- Provide, operate, and improve the Services;
- Process AI Credits subscriptions, billing, and refunds;
- Personalize your experience, including AI responses tailored to your prior interactions and preferences;
- Maintain platform safety, including automated content moderation, abuse prevention, and crisis-aware response handling;
- Communicate with you about your account, transactional notices, and important changes to the Services;
- Comply with applicable laws, respond to legal requests, and enforce our Terms of Service and Acceptable Use Policy;
- Conduct internal analytics and product research to improve quality.
4. AI Processing
Our Services use third-party artificial intelligence model providers to deliver conversational, image-generation, and voice-synthesis features. When you interact with the Services, content you submit may be processed by these providers in order to generate responses on our behalf. We work only with providers who contractually agree not to retain your data for their own model training purposes beyond what is required to deliver the immediate response.
We do not sell your personal information to AI model providers or any other third party for the purpose of training their models without your explicit, granular consent.
AI-generated outputs may be reviewed in aggregate, anonymized form for purposes of safety, quality assurance, and prompt engineering improvements.
5. How We Share Information
We share personal information only as described below:
- Service providers: hosting and infrastructure (e.g., cloud providers), database providers, payment processors, AI model providers, email and notification delivery services. These providers are contractually limited to processing data only for the purposes we direct.
- Legal compliance: when required by law, regulation, legal process, or governmental request, or to protect the rights, property, or safety of Wardrakes, our users, or the public.
- Business transfers: in connection with a merger, acquisition, financing, reorganization, or sale of assets. Continued use of the Services after such a transfer means you accept the privacy practices of the successor entity, which must offer the same or greater protections.
- With your consent: any other sharing with your prior, specific consent.
We do not sell personal information to data brokers or advertisers.
6. Data Retention & Account Deletion
We retain personal information for as long as your account is active and as needed to provide the Services, comply with legal obligations, resolve disputes, and enforce agreements. You can delete your account at any time — from within the app or website where account settings are offered, or by emailing contact@wardrakes.com. When you delete your account, we delete or anonymize your personal information within a reasonable period, typically 30 days, except where limited retention is legally required (e.g., financial records).
7. Your Rights
Depending on where you live, you may have rights over your personal information, including:
- Access: request a copy of the personal information we hold about you.
- Correction: request that inaccurate information be corrected.
- Deletion: request deletion of your account and associated personal information.
- Portability: request your information in a structured, machine-readable format.
- Objection or restriction: object to or restrict certain processing.
- Withdraw consent: where processing is based on consent, withdraw it at any time.
- Lodge a complaint: with your local data protection authority.
To exercise any of these rights, contact us at contact@wardrakes.com. We respond within the timeframes required by applicable law (typically 30 days).
California residents (CCPA/CPRA). You have the right to know what personal information we collect and how it is used, to access and request deletion or correction of your personal information, and to opt out of the "sale" or "sharing" of personal information. We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We will not discriminate against you for exercising these rights. To make a request, contact contact@wardrakes.com; we may need to verify your identity before fulfilling it.
EU/UK residents (GDPR). The Wardrakes' Inc. is the data controller for personal information collected through the Services. Our legal bases for processing are: performance of our contract with you (to operate the Services), your consent (for optional features such as image uploads and notifications), and our legitimate interests (security, fraud prevention, and improving the Services). You have the rights of access, rectification, erasure, restriction, portability, and objection, and the right to lodge a complaint with your local supervisory authority. Where we transfer data outside the EEA or UK, we rely on appropriate safeguards such as Standard Contractual Clauses.
8. Children
The minimum age to create an account or have personal information collected through the Services is 13 years old. We do not knowingly collect personal information from anyone under 13. If we learn that we have collected information from a person under 13 without verifiable parental consent, we will delete it promptly. If you believe we may have collected information from a child under 13, please contact us at contact@wardrakes.com.
Users aged 13 to 17. Users who are at least 13 but under 18 may use account-based Services only with the consent of a parent or legal guardian. The parent or guardian is responsible for the user's use of the Services and for any payments made through the user's account. Parents and guardians may contact us to review or delete a minor's information at any time.
Purchases. To make a purchase or initiate a subscription, the user must be at least 18 years old, or the purchase must be authorized in advance by a parent or guardian who is at least 18.
Age-restricted features. Certain features within our products are accessible only to users aged 18 or older and are gated by in-product age verification. Information collected in the course of using those features is processed as described elsewhere in this Policy.
Visit-only products. Some Wardrakes products — for example, free-to-play games — do not require account creation and do not directly collect personal information from users. Where such products are made available to general audiences (including users under 13) in accordance with their published age ratings, this Policy applies only to any limited information we may receive from the host platform on an aggregated, non-identifying basis.
9. Security
We implement reasonable administrative, technical, and physical safeguards to protect personal information, including encryption in transit (TLS), encryption at rest where appropriate, access controls, audit logging, and regular review of vendor security practices. No system is perfectly secure; we cannot guarantee absolute security but commit to notifying affected users of any breach in accordance with applicable law.
10. International Transfers
The Wardrakes' Inc. is based in the United States. Personal information you provide may be transferred to, stored in, and processed in the United States and other countries where our service providers operate. By using the Services, you consent to such transfers. Where required, we rely on standard contractual clauses or other lawful transfer mechanisms.
11. Changes to This Policy
We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors. When we make material changes, we will update the "Last Updated" date and, where appropriate, provide additional notice (such as an in-app notification or email). Your continued use of the Services after the updated Policy takes effect constitutes acceptance of the changes.
